and how you can get access to this information. Please review it carefully.
At Wavecrest Behavioral Health, we are committed to protecting your personal health information (PHI) in compliance with the Health Insurance Portability and Accountability Act (HIPAA). This Privacy Policy outlines how we may use and disclose your PHI, your rights regarding your PHI, and our obligations to protect it.
Your Rights
You have the following rights concerning your PHI:
- Right to Access: You can request to view or obtain a copy of your medical records and other health information we maintain. We will provide this information within 30 days of your request. A reasonable, cost-based fee may apply.
- Right to Amend: If you believe your medical information is incorrect or incomplete, you can request an amendment. We will respond within 60 days. If we deny your request, we will provide a written explanation.
- Right to Request Confidential Communications: You can request that we communicate with you in a specific manner or at a specific location. We will accommodate all reasonable requests.
- Right to Request Restrictions: You can ask us not to use or share certain health information for treatment, payment, or our operations. We are not required to agree to your request, but if we do, we will comply unless the information is needed to provide emergency treatment.
- Right to an Accounting of Disclosures: You can request a list of disclosures we have made of your PHI over the past six years, excluding disclosures for treatment, payment, and healthcare operations.
- Right to a Paper Copy of This Notice: You can request a paper copy of this notice at any time, even if you have agreed to receive it electronically.
- Right to Choose Someone to Act for You: If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information.
- Right to File a Complaint: If you believe your privacy rights have been violated, you can file a complaint with us or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
Your Choices
In certain situations, you have the right to make choices about how we use and share your information:
- Involvement in Your Care: You can tell us your preferences about sharing information with family, friends, or others involved in your care.
- Disaster Relief: You can tell us your preferences about sharing information in a disaster relief situation.
- Fundraising Communications: We may contact you for fundraising efforts, but you can tell us not to contact you again.
We will never share your information for marketing purposes, sell your information, or share most psychotherapy notes without your written permission.
Our Uses and Disclosures
We typically use or share your health information in the following ways:
Treatment: We can use your health information and share it with other professionals who are treating you.
Payment: We can use and share your health information to bill and receive payment from health plans or other entities.
Healthcare Operations: We can use and share your health information to run our practice, improve your care, and contact you when necessary.
Periodic Emails and Text Messages: We may use your email address and phone number to send you information and updates pertaining to your order. This may also include responses to your inquiries, questions, or other requests. You may also receive text messages with updates and promotional offers. You can opt out of receiving text messages at any time by replying STOP.
Other Uses and Disclosures
We are allowed or required to share your information in other ways—usually in ways that contribute to the public good, such as public health and research. We have to meet many conditions in the law before we can share your information for these purposes:
- Public Health and Safety Issues: We can share health information about you for certain situations such as preventing disease, reporting adverse reactions to medications, reporting suspected abuse, neglect, or domestic violence, and preventing or reducing a serious threat to anyone’s health or safety.
- Research: We can use or share your information for health research.
- Compliance with the Law: We will share information about you if state or federal laws require it, including with the Department of Health and Human Services.
- Organ and Tissue Donation Requests: We can share health information about you with organ procurement organizations.
- Medical Examiners or Funeral Directors: We can share health information with a coroner, medical examiner, or funeral director when an individual dies.
- Workers’ Compensation, Law Enforcement, and Other Government Requests: We can use or share health information about you for workers’ compensation claims, for law enforcement purposes, with health oversight agencies, and for special government functions such as military, national security, and presidential protective services.
- Lawsuits and Legal Actions: We can share health information about you in response to a court or administrative order, or in response to a subpoena.
Our Responsibilities
- We are required by law to maintain the privacy and security of your protected health information.
- We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
- We must follow the duties and privacy practices described in this notice and give you a copy of it.
- We will not use or share your information other than as described here unless you tell us we can in writing. If you tell us we can, you may change your mind at any time.
Changes to the Terms of This Notice
We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our office, and on our website.
